Division of powers

The division of powers is easier and more understandable under the Constitutional Treaty. An important feature is that the institutions of the EU receive their powers from the Member States. The latter are the "masters" of the Treaty establishing a Constitution for Europe. All powers that are not explicitly conferred on the Union remain with the Member States. The principles of subsidiarity and proportionality govern the exercise of powers.

Future division of powers into three categories of competences:

Exclusive competences of the Union
Competences shared by the Union and the Member States
Competences of the Member States, where the Union may take supporting, coordinating and complementary action
